General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter the "GTC") govern the contractual relationship between:

  • The Seller: EMIR CORPORATION, a simplified joint-stock company (société par actions simplifiée) operating the "Présentoirs à Bijoux" store, with share capital of €2,000, whose registered office is located at 42 Lotissement les Canneliers, 97224 Ducos, Martinique, France, registered with the Fort-de-France Trade and Companies Register under SIREN 988 555 637 (SIRET 988 555 637 00012), intra-Community VAT number FR78 988 555 637, reachable at info@presentoirbijoux.com.
  • The Customer: any natural or legal person, professional or non-professional, making a purchase on the presentoirbijoux.com website.

Any order placed on the website implies unreserved acceptance of these GTC. The Customer acknowledges having read them and accepted them before confirming their order.

Article 1 — Purpose

The purpose of these GTC is to define the rights and obligations of the parties in connection with the online sale, by EMIR CORPORATION (SAS), trading as "Présentoirs à Bijoux", of jewelry displays and display accessories.

Article 2 — Products

The products offered for sale are described and presented as accurately as possible. Photographs and descriptions are provided for information only and do not bind the Seller in the event of minor variations due in particular to screen rendering, handcrafted production or changes in the collections.

Products are offered while stocks last. If a product is unavailable after an order has been placed, the Customer will be informed as soon as possible and may obtain a refund of the amounts paid or opt for an equivalent product.

Article 3 — Prices

Prices are stated in euros (€), including all taxes (VAT included), excluding shipping costs. As the Seller is based in Martinique (an overseas department), specific VAT rules may apply in accordance with articles 294 et seq. of the French General Tax Code. The VAT regime applied is specified on the invoice.

Shipping costs are communicated before the order is confirmed and detailed in our shipping policy. The Seller reserves the right to change its prices at any time; products are invoiced at the prices in force at the time the order is confirmed.

Article 4 — Orders

The Customer places an order by selecting the items, confirming their cart, entering their delivery and billing details, then proceeding to payment. The order is definitively recorded once payment has been confirmed.

A confirmation email summarizing the order is sent to the address provided. The Seller reserves the right to refuse or cancel any order in the event of a prior dispute, suspected fraud, or an obvious pricing error.

Article 5 — Payment

Payment is made online, at the time of the order, by the means offered on the website (bank card, electronic wallets and other solutions displayed). Transactions are secured by Shopify Payments and/or its partners.

The Seller does not retain any banking details. The order is shipped only once payment has actually been received.

Article 6 — Delivery

Orders are shipped from Martinique. The delivery terms (areas served, carriers, lead times and costs) are set out in the shipping policy, which forms an integral part of these GTC.

The transfer of risk to the Customer takes place when the parcel is handed over to the final carrier. In the event of damage, loss or obvious delay, the Customer is invited to note any reservations with the carrier and to inform the Seller as soon as possible.

Article 7 — Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, a Customer who is a consumer has a period of fourteen (14) days from receipt of the last parcel to exercise their right of withdrawal, without having to give a reason.

To exercise this right, the Customer notifies their decision to withdraw by email to info@presentoirbijoux.com or by post to the company's address. The Customer may use the model form appended to these GTC.

The products must be returned in their original condition, complete and undamaged, within a maximum of fourteen (14) days following notification of withdrawal. Unless a specific offer applies, return costs are borne by the Customer. The return terms are set out in the return policy.

The refund is made no later than fourteen (14) days after receipt of the products or proof of their dispatch, using the same payment method as the one used for the order.

Article 8 — Legal guarantees

Regardless of any commercial guarantee, the Seller remains bound to the consumer by the following two legal guarantees:

  • Legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code): the Customer has two (2) years from delivery of the goods to take action. This guarantee makes it possible to obtain, at no cost, the bringing of the goods into conformity (repair or replacement), failing which a price reduction or termination of the contract. The Customer is exempt from proving the defect during the two years following delivery.
  • Guarantee against hidden defects (articles 1641 et seq. of the French Civil Code): the Customer may invoke this guarantee for any hidden defect rendering the goods unfit for their use, within two (2) years from discovery of the defect. The Customer may then choose between cancellation of the sale or a price reduction.

To exercise these guarantees, the Customer sends their request to info@presentoirbijoux.com, stating the order reference and the nature of the defect, together with photographs if possible.

Article 9 — Complaints and consumer mediation

Any complaint must be sent by email to info@presentoirbijoux.com.

In accordance with articles L.611-1 et seq. of the French Consumer Code, a Customer who is a consumer has the right to have recourse free of charge to a consumer mediator with a view to the amicable resolution of any dispute with the Seller, after first having attempted to resolve it directly by means of a written complaint.

Contact details of the consumer mediator to which the Seller subscribes: appointment in progress; their contact details will be published on this page upon membership.

The Seller cannot be held liable for any failure to perform its obligations resulting from a case of force majeure as defined by case law and article 1218 of the French Civil Code.

Article 12 — Governing law and jurisdiction

These GTC are governed by French law. Failing amicable resolution, any dispute shall fall within the jurisdiction of the French courts.
