General Terms and Conditions of Sale

These General Terms and Conditions of Sale ("GTC") govern the contractual relationship between EMIR CORPORATION, a simplified joint-stock company (société par actions simplifiée) operating the "Présentoirs à Bijoux" store, with share capital of €2,000, whose registered office is at 42 Lotissement les Canneliers, 97224 Ducos, Martinique, France, registered with the Fort-de-France Trade and Companies Register under SIREN 988 555 637 (SIRET 988 555 637 00012), intra-community VAT number FR78 988 555 637, and any person making a purchase on presentoirbijoux.com.

Article 1 — Purpose

Online sale of jewelry displays and display accessories.

Article 2 — Products and prices

Prices are in euros, including tax, excluding shipping costs. As the Seller is based in Martinique, specific VAT rules apply (Articles 294 et seq. of the French General Tax Code). The tax regime is stated on the invoice.

Article 3 — Order and payment

The order becomes final once payment has been validated (Shopify Payments). The Seller does not retain any banking details.

Article 4 — Delivery

Shipped from Martinique. Full terms are set out in the shipping policy. Risk is transferred to the Customer when the parcel is handed over to the final carrier.

Article 5 — Right of withdrawal (14 days)

Articles L.221-18 et seq. of the French Consumer Code. 14 days from receipt of the last parcel. Notification to be sent to info@presentoirbijoux.com. Products must be returned within 14 days of notification, to the registered office address. Return costs are borne by the Customer (except in the case of a special promotion). Refund within 14 days using the same payment method.

Article 6 — Legal guarantees

Legal guarantee of conformity: 2 years from delivery (Articles L.217-3 et seq. of the French Consumer Code). Guarantee against hidden defects: 2 years from discovery of the defect (Articles 1641 et seq. of the French Civil Code).

Article 7 — Complaints and mediation

Complaints: info@presentoirbijoux.com. Failing an amicable solution, free mediation is available (Articles L.611-1 et seq. of the French Consumer Code). Mediator: appointment in progress; their contact details will be published on this page as soon as we have joined. EU online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 8 — Personal data

Article 9 — Force majeure

Article 1218 of the French Civil Code.

Article 10 — Governing law and jurisdiction

French law. For consumer Customers, the jurisdiction provided for by the applicable rules (Article R.631-3 of the French Consumer Code).
